I have read FBI Director James Comey's full statement about the Clinton e-mails and have also listened to much of his following congressional testimony. I found it much like reading Chief Supreme Court Justice Roberts’ explanation, which allowed Obamacare to continue because of a reinterpretation of whether a nontax is really a tax. Comey's decision not to recommend Clinton's prosecution made perfect sense as long as one ignored specific parts of the relevant statutes that allowed prosecution in the event of gross negligence or knowing removal of classified material from appropriate systems or storage facilities. Interestingly, Comedy began his public statement by citing those very statutes that he ultimately ignored.
