City goes to war with developer

Legal grenades start to explode

EDINBURG – A war between the city of Pharr and D&M Ventures LLC, -- the developer of its new apartment complex, Jackson Place Apartments -- has started to explode. The city filed a lawsuit against D&M March 20, 2018, and the verbiage contained therein reads like an all-out verbal attack.

When it comes to being a bleeding heart, count me in – I help the down-and-out whenever I can. Only difference between me and most bleeding hearts is that I actually have a thinking brain. Okay, some would argue the point, but so be it.
I’m neither a member of the Republican or the Democratic Party. Rather, I’m a member of the Common Sense Party. Sadly, the French writer/philosopher Voltaire was right when he famously said, “Common sense isn’t so common.” With each passing generation, it seems that a lesser percentage of the population possess it.
You know what I find sickening? Stories in the local media about the poor immigrants “fleeing the violence and poverty” in Central America. I see too many news reporters tripping over themselves as they race to interview the next
lawsuit filed against D&M’s principle owner, David Marquez, and the other defendants named in it, plaintiffs’ attorney Chris Franz (Peralez & Franz LLP) describes what allegedly went on during the Jackson Place development, capitalization, and its 2016/2017 construction, which includes words and phrases such as:
“…highly negligent; a developer with extremely questionable ethical and legal background; carelessness, profiteering, negligence, delay, deceit, and subterfuge; hire(d) a bevy of his cronies; a sleazy practice; distributed to himself and his cronies hundreds of thousands of dollars in layering expenses that were not earned and to which they were not entitled; theft of funds; fox guarding the henhouse; grossly negligent; massive bidding of actual project costs; the classic bait and switch; in order to
